Terms and Conditions

The Sunshine Coast Health Foundation (Wishlist) (ABN 473 705 44 251) own the domain name www.wishlist.org.au and operate a website upon such domain name, for public use, (the “Wishlist Website”).

By accessing and using the Wishlist Website, the user accepts the terms and conditions of use set out herein (the “Terms of Use”), without qualification.

Any user that does not accept the Terms of Use should refrain from accessing and using the Wishlist Website and the Sunshine Coast Health Foundation (Wishlist) will not accept liability for any loss or damage should the user continue to use the Wishlist Website without acceptance of these Terms of Use.

Applicable Law

  1. The Wishlist Website has been prepared for use by an Australian audience and in compliance with Australian law.
  2. The Terms of Use are governed by the law applicable in the State of Queensland and the user irrevocably and unconditionally submit to the exclusive jurisdiction of the court of Queensland.
  3. Where any provision or part thereof of these Terms of Use is deemed illegal or unenforceable it will be severed from the Terms of Use and the remaining provisions or parts thereof will continue in force and effect.

Intended Audience

  1. Information provided upon the Wishlist Website has been prepared for an Australian audience over the age of 18 years of age.
  2. The user warrants that they are accessing the Wishlist Website from within Australia and are over the age of 18 years.
  3. Any user accessing the Wishlist Website from outside Australia does so at their own risk and indemnifies The Sunshine Coast Health Foundation (Wishlist) against any loss or damage suffered by the user for accessing the Wishlist Website in contravention of any applicable law within the user’s country of residence.
  4. Where a user accesses and uses the Wishlist Website from outside of Australia it is the users responsibility to ensure that that access and use is undertaken in compliance with any relevant laws in force within the user country of residence.

Intended Use

  1. Information provided upon the Wishlist Website is intended for personal use only and is not intended to be provided for commercial value or use.
  2. All health information, material, opinion or guidance upon the Wishlist Website is not intended to be a substitute for professional medical advice and is for general information only.
  3. The Sunshine Coast Health Foundation (Wishlist) does not warrant that the health information, material, opinion or guidance is current, accurate or complete.
  4. Where health information, material, opinion or guidance is provided by any third party using the Wishlist Website, The Sunshine Coast Health Foundation (Wishlist) does not endorse such material nor warrant that it is current, accurate or complete.
  5. Any user using the health information, material, opinion or guidance provided upon the Wishlist Website does so at their own risk and indemnifies The Sunshine Coast Health Foundation (Wishlist) against any loss or damage suffered by the user for using such material.
  6. The Sunshine Coast Health Foundation (Wishlist) advices that and the user accepts that independent professional medical advice should be sought before utilising the health information, material, opinion or guidance for the diagnosis or treatment of any medical or health problem.

Allowable Use

  1. The user may use the Wishlist Website to view, read, print or otherwise download content stored or viewable for caching or future use for personal purpose only.
  2. The user agrees not to use the Wishlist Website for any commercial purpose or product.
  3. The user must not republish, sell, re-distribute or reproduce any material accessed upon the Wishlist Website, without the prior express written permission of The Sunshine Coast Health Foundation (Wishlist).
  4. The user must not amend, edit, or in any way distort any of the material contained upon the Wishlist Website.

Intellectual Property

Subject to the Terms of Use herein, The Sunshine Coast Health Foundation (Wishlist) own and control all copyright subsisting within all content published upon the Wishlist Website, including, but not limited to;

  1. Logos;
  2. Brand names;
  3. Text;
  4. Photographs;
  5. Information;
  6. Statistics; and
  7. Graphical images.
  8. All copyright, trademark and other intellectual property rights in the Wishlist Website and its content are reserved.
  9. Where third party content is shown, or available by external link, The Sunshine Coast Health Foundation (Wishlist) does not represent or warrant that the content does not infringe the intellectual property rights of any third party.

Limitations of Use

  1. The Sunshine Coast Health Foundation (Wishlist) does not warrant that the information and material upon the Wishlist Website;
  2. Is complete, accurate or up-to-date;
  3. Is free of errors, typographical or otherwise;
  4. Is free of viruses, Trojans or any other malicious software; and
  5. Will remain available to the user.

Exclusion of Liability

  1. To the greatest extent permitted by law, The Sunshine Coast Health Foundation (Wishlist) excludes all representations and warranties in regard to the content of the Wishlist Website and the use of the Wishlist Website and any liability to you, whatsoever.
  2. It is a condition of access and use of the Wishlist Website that the user indemnify Sunshine Coast Health Foundation (Wishlist), including its officers, employees, agents, members, volunteers, collaborators etc. from any loss or damage suffered by the user as a result of use of the Wishlist Website, including and without limitation, any commercial losses or loss of opportunity.

Third Party Content, Hyperlinks, Advertising

  1. The Wishlist Website may contain content of third parties, either directly through re-publishing, via external link to another domain name or through advertisements.
  2. Where content is provided by third parties The Sunshine Coast Health Foundation (Wishlist) does not endorse, recommend or approve any product or service that may be offered or provided by those third parties.
  3. The Sunshine Coast Health Foundation (Wishlist) does not control the content of any external link and the user accesses that third party content and uses it at their own risk, or within the terms of use provided by that third party.
  4. The Sunshine Coast Health Foundation (Wishlist) does not provide any representation or warranty regarding the quality, merchantability or fitness for purpose of any content, service or product provided by any third party.
  5. The user acknowledges and accepts that The Sunshine Coast Health Foundation (Wishlist) may receive payments from a third party as a result of the user following an external link to a third party or purchasing a product or service of a third party.

Registration

  1. The Wishlist Website allows users to register their personal details with The Sunshine Coast Health Foundation (Wishlist) and create an account.
  2. It is the user’s responsibility to ensure that any personal details provided is in all respects true and accurate and not intended to mislead.
  3. The user warrants that any personal details provided to The Sunshine Coast Health Foundation (Wishlist) are details that are personal to them and are not in respect of any third party.
  4. The user accepts that any personal details provided may be used by The Sunshine Coast Health Foundation (Wishlist) for the advancement of the interests of The Sunshine Coast Health Foundation (Wishlist), whether by promotion, advertising, marketing or otherwise.
  5. The Sunshine Coast Health Foundation (Wishlist) reserves the right to suspend or cancel any registered account at any time and within The Sunshine Coast Health Foundation (Wishlist)’s sole discretion.
  6. The user may cancel their registered account at any time.

Wishlist Events, Functions and Programs

  1. The Sunshine Coast Health Foundation (Wishlist) may organise, operate or advertise an event, function or program.
  2. Should the user participate or attend any event, function or programs, the user does so at their own risk and are advised to refer to any specific terms and conditions relating to that event, function or program.
  3. Should the event, function or program require the user to participate in any physical exertion or exercise, The Sunshine Coast Health Foundation (Wishlist) recommends that the user consult with their health care professional prior to participating.
  4. The user warrants that they have consulted with their health care professional prior to participating in any event, function or program.
  5. Refund Policy – My ticket is transferable to other people, if notified in writing to Wishlist no less than 48 hours prior to the event (email to: info@wishlist.org.au). If I am unable to attend, or if the event is cancelled by way of circumstances beyond the control of the event directors, my registration fee is transferable however is non-refundable. A transfer fee may apply.

Wishlist Merchandising

  1. The Sunshine Coast Health Foundation (Wishlist) may make available for purchase on the Wishlist Website merchandise, such as polo shirts, caps, clothing, water bottles and corporate gifts.
  2. Unless otherwise indicated, all prices listed upon the Wishlist Website are inclusive of General Sales Tax.
  3. Goods purchased via the Wishlist Website are purchased from Australia and are afforded the protections under the Australian Consumer Law.
  4. The Sunshine Coast Health Foundation (Wishlist) does not otherwise warrant, represent or guarantee the quality, merchantability or fitness for purpose of the goods purchased via the Wishlist Website.

Privacy Policy

Variations

  1. These Terms of Use may be revised by The Sunshine Coast Health Foundation (Wishlist) at any time.
  2. If revised, the revised Terms of Use shall apply at the time of publication.
  3. It is the user’s responsibility to ensure that the user remains familiar with the Terms of Use of the Wishlist Website at the time of each access to the Wishlist Website.
  4. The user waives any right they may have to be notified of or provide further consent to any revised Terms of Use of the Wishlist Website.

Wishlist Logo, Affiliates and Use

  1. The Sunshine Coast Health Foundation (Wishlist) logo may not be used by any third party without the prior written consent of The Sunshine Coast Health Foundation (Wishlist).
  2. Where permission is granted to use the The Sunshine Coast Health Foundation (Wishlist) logo for the purpose of linking or affiliating with the Wishlist Website, the following conditions must apply;
  3. No responsibility or liability will lie with The Sunshine Coast Health Foundation (Wishlist) for any errors or omissions resulting from its use;
  4. No affiliate or link will endorse, either expressly or impliedly any product, service, promotion or merchandise;
  5. No affiliate or link will suggest, either expressly or impliedly that cigarettes, drugs or alcohol are related to the promotion of health;
  6. If wording is to be used to promote the Wishlist Website and its interests then the following wording must be used, without amendment;

“Wishlist is a not-for-profit organisation dedicated to fundraising for the needs of our local public health services. Annually we pledge $1 million to providing new and upgraded equipment, training, support programs and research funding for the Sunshine Coast Hospital and Health Service. Since 1998 Wishlist with the help of a generous and committed community, has directed more than $18 million towards supporting the Coast’s health system.

  1. The Sunshine Coast Health Foundation (Wishlist) reserves the right to withdraw permission to affiliate or link to the Wishlist Website at any time and in its sole discretion.
